A United States federal judge has certified as a class over 200 Filipino nurses in a human trafficking lawsuit against New York's largest group of nursing homes.

The Sept. 11 decision provides that any nurse recruited by the Sentosa Agency in the Philippines and employed in the US since Dec. 23, 2008 shall be part of a class suit against the nursing home.

This after Filipino nurse Rose Ann Paguirigan accused the Sentosa group of nursing homes of threatening Filipino nurses to force them into working for less than prevailing wages.

The company allegedly promised that it would pay Filipino nurses the prevailing wage at the start of their employment in New York.

But once a Filipino nurse arrives in New York, he or she only gets paid the prevailing wage as of the date his or her visa application was first submitted. Visa applications usually take 6 to 8 years, according to the plaintiff.

Employment contracts of Filipino nurses in the company also requires them to pay up to $25,000 if they decide to leave before the end of their 3-year contract.

With the recent class certification, any Filipino nurse recruited and employed by Sentosa Services since 2008 would no longer have to file an individual complaint.

“When employers pay foreign nurses less than the prevailing wage, they depress wages and opportunities for all nurses. Today’s decision is a victory for all the nurses who work so hard to take care of our loved one," Paguiringan's lawyer John Howley said in a statement.
